1.1Senator Benson moved to amend H.F. No. 2414, as amended pursuant to Rule 45,
1.2adopted by the Senate April 29, 2019, as follows:

1.4Page 363, after line 29, insert:

1.6    Subdivision 1. Scope of coverage. This section applies to all health plans issued or
1.7renewed to a Minnesota resident.
1.8    Subd. 2. Definitions. (a) For the purposes of this section, the terms defined in this
1.9subdivision have the meanings given them.
1.10(b) "Cost-sharing" means a deductible payment, co-payment, or coinsurance amount
1.11imposed on an enrollee for a covered prescription drug in accordance with the terms and
1.12conditions of the enrollee's health plan.
1.13(c) "Legend drug" has the same meaning as in section 151.01, subdivision 17.
1.14(d) "Prescription insulin drug" means a legend drug that contains insulin and is used to
1.15treat diabetes.
1.16(e) "Net price" means the health plan company's cost for a prescription insulin drug,
1.17including any rebates or discounts received by or accrued directly or indirectly to the health
1.18plan company from a drug manufacturer or pharmacy benefit manager.
1.19    Subd. 3. Cost-sharing limits. (a) A health plan that imposes a cost-sharing requirement
1.20on the coverage of a prescription insulin drug shall limit the total amount of cost-sharing
1.21that an enrollee is required to pay at point of sale, including deductible payments and the
1.22cost-sharing amounts charged once the deductible is met at an amount that does not exceed
1.23the net price of the prescription insulin drug.
1.24(b) Nothing in this section shall prevent a health plan company from imposing a
1.25cost-sharing requirement that is less than the amount specified in paragraph (a).
1.26EFFECTIVE DATE.This section is effective for health plans issued or renewed on or
1.27after January 1, 2020."
1.28Renumber the sections in sequence and correct the internal references
1.29Amend the title accordingly
