1.3 "Sec. 8. Minnesota Statutes 2024, section 241.021, subdivision 4, is amended to read:
1.4 Subd. 4.
Health care. (a) The commissioner of corrections shall provide professional
1.5health care to persons confined in institutions under the control of the commissioner
of
1.6corrections and pay the costs of their care in hospitals and other medical facilities
not under
1.7the control of the commissioner of corrections. All reimbursements for these health
care
1.8services shall be deposited in the general fund. The commissioner of corrections is
authorized
1.9to contract with or reimburse entities, including health care management companies,
to
1.10provide health care to inmates, at reimbursement rates equal to medical assistance
unless
1.11otherwise negotiated. With respect to these contracts, these entities shall not be
regulated
1.12as, or otherwise considered to be, health plan companies as defined in section
62Q.01,
1.13subdivision 4.
1.14(b) For purposes of paragraph (a), "health care" does not include gender-affirming
care,
1.15as defined in section 62Q.585."
