1.1Senator Wesenberg moved to amend S.F. No. 3 as follows (...):
1.2Page 132, after line 2, insert:

1.3    "Sec. 4. Minnesota Statutes 2024, section 84D.01, is amended by adding a subdivision to
1.4read:
1.5    Subd. 6a. Eviscerated. "Eviscerated" means to have the internal organs removed from
1.6the body cavity or to have the gills severed to ensure that an organism is dead.

1.7    Sec. 5. Minnesota Statutes 2024, section 84D.05, subdivision 1, is amended to read:
1.8    Subdivision 1. Prohibited activities. A person may not possess, import, purchase, sell,
1.9propagate, transport, or introduce a prohibited invasive species, except:
1.10(1) under a permit issued by the commissioner under section 84D.11;
1.11(2) in the case of purple loosestrife, as provided by sections 18.75 to 18.88;
1.12(3) under a restricted species permit issued under section 17.457;
1.13(4) a person may possess, import, purchase, sell, and transport bighead carp, grass carp,
1.14and silver carp if they are dead and eviscerated;
1.15(4) (5) when being transported to the department, or another destination as the
1.16commissioner may direct, in a sealed container for purposes of identifying the species or
1.17reporting the presence of the species;
1.18(5) (6) when being transported for disposal as part of a harvest or control activity when
1.19specifically authorized under a permit issued by the commissioner according to section
1.20103G.615, when being transported for disposal as specified under a commercial fishing
1.21license issued by the commissioner according to section 97A.418, 97C.801, 97C.811,
1.2297C.825, 97C.831, or 97C.835, or when being transported as specified by the commissioner;
1.23(6) (7) when being removed from watercraft and equipment, or caught while angling,
1.24and immediately returned to the water from which they came;
1.25(7) (8) when being transported from riparian property to a legal disposal site that is at
1.26least 100 feet from any surface water, ditch, or seasonally flooded land, provided the
1.27prohibited invasive species are in a covered commercial vehicle specifically designed and
1.28used for hauling trash; or
1.29(8) (9) as the commissioner may otherwise prescribe by rule."
1.30Renumber the sections in sequence and correct the internal references
2.1Amend the title accordingly
