Overview

HF 745 prohibits marriages by minors; requires marriage license applicants to submit proof of age; and prohibits the state from recognizing any marriage involving a minor if the parties entered into a marriage in another state while one of them was a resident of Minnesota.

Summary

Sec. 1. Persons capable of contracting. Deletes language related to process in current law for a minor who is 16 years of age or older to receive a marriage license.

Sec. 2. General. Prohibits marriage for minors who are under the age of 18. Prohibits the state from recognizing a marriage involving a minor in another state if one of the parties to the marriage was a Minnesota resident at the time of the marriage.

Sec. 3. Form. Makes a conforming change.

Sec. 4. Term of license; fee; premarital education. Both parties applying for a marriage license must submit proof of age to the local registrar.

Sec. 5. Proof of age. Provides that the following documents may be used as proof of age: original or certified copy of a birth certificate, driver’s license or other government or school issued ID, a school record, immigration record, naturalization record, court record, or other document or record issued by a government entity that contains the date of birth of a party.

Effective Date. Sections 1 to 4 are effective August 1, 2020, and apply to marriages entered into on or after that date. Section 5 is effective August 1, 2020.
