Section 1. Mileage-based user fee pilot program. This section requires the commissioner of transportation to establish a mileage-based user fee (MBUF) pilot program.

Subdivision 1. Pilot program established. The commissioner of transportation must develop a pilot program in the state to look at developing a MBUF system in Minnesota.

Subdivision 2. Objectives. The pilot project must consider past research conducted in Minnesota, identify and implement steps necessary to develop a MBUF system; demonstrate and evaluate approaches to the program; analyze options; and the project must result in a near-term capacity to implement or phase in a statewide MBUF system.

Subdivision 3. Administration. The commissioner of transportation may establish an advisory panel, enter into agreements, partner with other states, develop recommendations for MBUF system design, and produce an implementation plan for implementing a MBUF system statewide.

Subdivision 4. Pilot program data. Data on individuals that participate in the pilot program is nonpublic data or private data on individuals. Summary data may be produced. The commissioner may only share nonpublic data with law enforcement pursuant to a search warrant.

Subdivision 5. Legislative report. By December 1, 2021, the commissioner must submit a report on the pilot program to the legislature.

Section 2. Appropriation; mileage-based user fee pilot program. A blank appropriation is made in fiscal year 2020 from the highway user tax distribution fund to the commissioner for the MBUF pilot program.
