S.F. No. 449 - DWI Law, Peace Officer Definition

Author: Senator Gregory D. Clausen

Prepared By: Kenneth P. Backhus, Senate Counsel (651/296-4396)

Date: January 29, 2019

SF No. 449 amends the definition of “peace officer” in the DWI law by striking the current limitation on the scope of the definition applicable to conservation officers (COs). Under current law, a CO is considered a peace officer for DWI-related purposes only for DWIs committed in off-road recreational vehicles and motorboats and for hunting while impaired offenses. This change removes that restriction so that a CO has the same authority regarding DWIs as do other peace officers.
