Section 1 amends the fireworks regulation law to expand the types of fireworks that are legal in the state.  Under the amendment, a broader class of fireworks defined as consumer fireworks will now be legal.

Strikes language in current law on fireworks, including the definition of fireworks.  Adds definitions for “APA 87-1,” “consumer fireworks,” “display fireworks,” “fireworks,” “novelties,” and “sparkling devices.”

Provides that consumer fireworks and sparkling devices may not be used on public property or purchased by persons younger than 18 years of age, and requires that persons selling these items verify the purchaser’s age by photographic identification.

Addresses the fees that local units of government may impose and the powers that those units possess in terms of regulating legal fireworks. (These issues (new paragraphs (c) to (e) on pages 2 and 3) are under the jurisdiction of the Local Government Committee.)
