S.F. No. 1099 - Applicability of Pistol Permit Law to Peace Officers

Author: Senator Warren Limmer

Prepared By: Kenneth P. Backhus, Senate Counsel (651/296-4396)

Date: March 14, 2017

S.F. No. 1099 amends the pistol permit law to clarify that an owner/operator of a private establishment may not prohibit a peace officer from carrying under the provision of the law that allows these establishments to prohibit carry by posting notice. This has the effect of clarifying that off duty officers may carry within private establishments even if the owner objects. The bill essentially overrides the holding of a 2015 unpublished Court of Appeals decision.
