SF 1422 corrects cross-references, consolidates the effective dates of various nursing facility payment rate adjustments, and modifies the notice nursing facilities must provide to private-paying residents prior to the effective date of a payment rate adjustment.
Sections 1 – 5 and sections 7 – 8 modify the effective dates of various nursing facility payment rate adjustments so that the adjustments are effective on either July 1 or January 1 following the event that qualifies the facility for the rate adjustment.
The following rate adjustments are included in these sections: consolidation rate adjustments; property-related payment rate adjustments following a construction project; property-related payment rate adjustments following a major addition to or replacement of a facility; property-related payment rate adjustment following bed layaway or delicensure; property-related payment rate adjustments following a “threshold” construction project; planned closure payment rate adjustments; and single-bed room incentive payments.
Section 5 (Notice to Residents – 256R.06, subdivision 5) modifies a facility’s duty to inform private-paying residents of changes in their rates by requiring notice of any adjustment to the rate, not only increases. In addition, requires rate adjustment notices to private-paying residents to include the amount of the adjustment, the new rate, and the effective date of the new rate.
