This bill amends DWI provisions regarding test failures and refusals by taking into account the use of search warrants in both cases. It strikes language under the test refusal provision stating that the test must not be given, since the peace officer could obtain a warrant. In addition, it adds language under test failure indicating that the test may be obtained under the implied consent law or a search warrant.
