Section 1 [Disparity Impact Notes] establishes a requirement and process for the Commissioner of Management and Budget to coordinate disparity impact notes for legislation when a disparity impact note is requested by the chair or ranking minority member of a standing committee if it appears that the legislation would significantly increase or decrease disparities if the legislation were enacted. Defines “disparities” as differences in economic, employment, health, education, or public safety outcomes between the state population as a whole and subgroups of the population defined by race, gender, and geography to the extent data is available.
Section 2 [Disparity Impact; New and Existing State Programs]
Subdivision 1 [New programs; definition] requires state agencies to certify to the Commissioner of Human Rights for each new program what actions the agency has taken to ensure, to the extent practicable, that the new program will decrease or, at a minimum, not increase relevant disparities.
Subdivision 2 [Existing programs] requires state agencies to certify twice each year to the Commissioner of Human Rights the actions the agency has taken during a specified time to ensure, to the extent practicable, that the agency’s administration of laws and programs will decrease or, at a minimum, not increase existing disparities.
Subdivision 3 [Evaluation and recommendation] requires the Commissioner of Human Rights to evaluate each agency’s certified actions and recommend additional actions the agency should take to address or decrease disparities.
Subdivision 4 [Annual report required] requires the Commissioner of Human Rights to report annually to the legislature about each agency action certified during the year, the commissioner’s agency-specific recommendations, and recommendations to the legislature.
Section 3 [Performance Measures and Disparity Analysis for Change items] requires the governor to include, for each change item in the governor’s budget proposal, a succinct analysis of whether new or increased funding is likely to increase or decrease disparities.
