The bill requires peace officers, upon the request of a driver or a driver’s counsel, to disclose to the requestor the preliminary breath test results immediately upon the administration of the test.

If the peace officer does not comply with the request, the test result may not be used in any license revocation, DWI, or underage drinking and driving proceeding.

The bill is effective August 1, 2015, and applies to preliminary screening tests administered on or after that date.
