 Overview

In 2013, the legislature assigned to the Legislative Commission on Planning and Fiscal Policy (LCPFP) the biennial duty to compile a list of executive branch advisory groups created in statute.  The LCPFP was invited to develop a schedule of review of advisory groups and make recommendations on the continuing need for certain advisory groups and on any changes in laws that were needed to improve efficiency and effectiveness of groups. 

The LCPFP conducted a review of executive branch groups in the months that preceded the 2014 session.  The result of their work is reflected to a substantial degree in this bill that amends laws governing executive branch advisory groups. Most of the changes in this bill repeal advisory groups or statutory references to those groups. Advisory groups not included in this bill generally will continue in existence under the current laws, some of which provide expiration dates specific to an advisory group.

This bill repeals Minnesota Statutes, section 15.059, subdivision 5, which provided that some executive branch advisory groups expired on June 30, 2009.

Section 13 [Clarification of Continued Existence] clarifies that the following groups did not expire on June 30, 2009, and that their actions take and public funds spent are valid:  Medical Assistance Drug Formulary Advisory Committee; Environmental Health Tracking and Biomonitoring Advisory Panel; Water Supply system and Wastewater Treatment Facilities Advisory Council; and the Prescription Electronic Reporting Advisory Committee.

 Article 8: Conforming Changes

Article 1 of this bill repeals section 15.059, subdivision 5, that expired some advisory groups on June 30, 2009.  Article 8 strikes references to, and makes other conforming changes in light of, this repealed section.
