Section 1 prohibits: (1) law enforcement agencies from hiring new part-time peace officers; (2) part-time peace officers from moving to new agencies; and (3) the POST Board from licensing new part-time peace officers.  Part-time peace officers who are currently employed may continue to serve indefinitely with their current employer.  However, if a part-time peace officer leaves the officer’s place of employment or is otherwise unemployed after the effective date of this act, the officer must surrender their license.

Section 2 instructs the POST Board to update the Board’s rules to reflect the policy changes contained in the bill. 

Section 3 repeals the following Minnesota Statutes and Rules:

  • Section 626.8462 (Competency Requirement);
  • Section 626.8464 (New Part-Time Peace Officer Positions);
  • Section 626.8465, subdivision 3 (Emergency Appointment); and,
  • Section 626.8468, subdivision 2 (Expanded Training Required).
  • Minnesota Rules, part 6700.1101, subparts 5 and 6.

Section 4 provides that the bill is effective the day following final enactment.
