Section 1 [Confidential Employee] modifies the definition of “confidential employee” for purposes of the Public Employee Labor Relations Act (PELRA).  Under current law, an employee who, as part of the employee’s job duties, “has access to” labor relations information is a confidential employee.  This bill changes this provision so that an employee would have to be “required to access and use” labor relations information to be a confidential employee.  (Current law provides that employees who actively participate in meeting and negotiating on behalf of a public employer are “confidential employees;” this category of confidential employees is unchanged by this bill.)
