Section 1 [Farmers’ market or community event; food product sampling and demonstration]
Subd. 1 [Definitions] defines “farmers market,” “food product sampling,” and “food product demonstration” for the purposes of excluding food product tasting and demonstration from food handler licensing law in the bill.
Subd. 2 [Food sampling and demonstration exclusion] provides that the food handler licensing law does not apply to food product sampling and demonstration at farmers’ markets or community events.
Subd. 3 [Food to be supplied at no cost] provides that food product sampling and demonstration must be provided at no cost.
Subd. 4 [Regulatory authority oversight] requires any person conducting food product sampling or demonstration must provide to the regulatory authority, upon request:

the sources of the food;

the type and volume of the food;

the equipment used;
-
the time period and location;
-
the availability of facilities for hand washing;

information on facilities for ware washing;

the available source of water; and
-
methods for waste disposal.
Subd. 5 [Food safety and equipment standards] provides that a person conducting food product sampling or food product demonstrations at farmers’ markets or community events must meet certain standards that are required for special event food stands under rules of the Department of Health.
Subd. 6 [Definition exception] clarifies that the definition of “farmers’ market” in statute does not preclude a farmers’ market association from establishing their own definition of a farmers’ market that is more restrictive.
Section 2 [Seasonal temporary food stand] allows the regulatory authority having jurisdiction over the food establishment to allow a temporary food stand to be in any one place for longer than 21 days.
