        The bill adds three felonies to, and strikes three felonies from, the definition of “Crime of Violence” under Minnesota Statutes, section 624.712, subdivision 5, for the purposes of regulating firearms.  The felonies added are:

  • Section 609.224, (felony assault in the 5th degree);
  • Section 609.2242 (felony domestic assault); and,
  • Section 609.2247 (felony assault by strangulation).

The felonies deleted are:

  • Section 609.52, (car theft);
  • Section 609.52, (looting); and,
  • Section 609.582, (3rd degree burglary).

Section 624.713, subdivision 2, prohibits persons convicted of a crime of violence from possessing firearms.

The penalty for violating section 624.713, subdivision 2, is imprisonment for up to 15 years, a fine of up to $30,000, or both.

The bill has an August 1, 2014, effective date, and applies to crimes committed on or after that date.
