S.F. No. 2009 - Modifying Filing of Petition for Relief from Conviction

Author: Senator Dan Hall

Prepared By: Chris Turner, Senate Fiscal Analyst (651/296-4350)

Date: March 19, 2014

Section 1 eliminates the requirement that a petition for postconviction relief be accompanied by three copies.  The original, signed by either the petitioner or the petitioner’s attorney is sufficient.  Deletes the requirement that the court administrator deliver copies of the petition to the county attorney and the attorney general.

Section 2 strikes the Board of Public Defense caseload and reimbursement annual report requirement.

Section 3 deletes language stating that notice to an offender’s attorney is deemed notice to an offender regarding the restitution challenge 30-day timeline.
