S.F. No. 2399 - Sale of Hospital District Property to Private Hospital (First Engrossment)

Author: Senator Vicki Jensen

Prepared By: Alexis C. Stangl, Senate Counsel (651/296-4397)

Date: March 18, 2014

Section 1 authorizes the District 1 hospital district, located in the city of Faribault in Rice County, to sell the personal and real property of the district to a private hospital.  This section is effective the day following final enactment.

Paragraph (a), allows the district to sell, convey, and transfer management, control, and operation of the hospital and hospital property.  The district may sell personal property associated with the property as part of the negotiated sale price.  Advertising for bids is not required.

Paragraph (b) provides the legal descriptions of the properties referred to in paragraph (a).

Paragraph (c) provides that when the district board determines that all sale requirements have been met and there are sufficient funds to pay off all outstanding bonds, each city or town in the district must file a petition for dissolution with the board.

Section 2 repeals laws relating to the hospital district.  Laws 1961, chapter 372, sections 1 and 2, authorize the Rice County Board of Commissioners, acting as the governing body of the hospital district, to tax and bond for the hospital.  Laws 1963, sections 1 to 10, establish the District 1 hospital district and hospital board and provide for its obligations and duties.  Laws 1996, chapter 471, article 8, sections 19 to 22, amend the 1963 law. This section is effective upon the cities in the district filing a petition with the hospital board.
