S.F. No. 2733 - Modifying Provisions Governing the Administration of Neuroleptic Medication (with the A-1 Amendment)

Author: Senator Chris A. Eaton

Prepared By: Joan White, Senate Counsel (651/296-3814)

Date: March 16, 2014

Sections 1 and 2 (253B.07, subdivision 7, 253B.09, subdivision 2) are deleted in the author’s amendment.

Section 3 (253B.092, subdivision 2) allows neuroleptic medications to be administered if the patient has been prescribed neuroleptic medication but lacks the capacity to consent, continued administration is in the patient’s best interests, and the patient does not refuse the medication.  Under these circumstances, the medication may be continued for up to 14 days while the physician is obtaining a substitute decision-maker, or is requesting an amendment to the current court order authorizing administration of the medication.

Section 4 allows the Commissioner of Human Services to establish a pilot program to respond to issues raised in the Office of the Legislative Auditor report on state-operated services.  The pilot may include no more than three counties, and the commissioner shall provide a status update to the chairs and ranking minority members no later than January 15, 2015.
