Section 1 (256B.04, subdivision 21) specifies that only durable medical equipment, prosthetics, orthotics, and supplies providers that meet the new definition of “durable medical equipment providers and suppliers” are subject to surety bond requirements, and changes the term “performance bond” to “surety bond.”

Sections 2 (256B.5016, subdivision 1) and 3 (256B.69, subdivision 16) remove obsolete cross-references to Minnesota Rules.

Section 4 (393.01, subdivision 2) removes language requiring  the Commissioner of Human Services to appoint local social service agency members, instead requiring boards of county commissioners to make the appointments.

Section 5 (393.01, subdivision 7) removes language requiring the Commissioner of Human Services to appoint local social service agency members when multiple counties have agreed to combine social service functions, instead requiring each board of county commissioners entering into the agreement to appoint one noncounty commissioner member.

Section 6 (Laws 2011, First Special Session chapter 9, article 9, section 17) eliminates an annual streamlining eligibility and enrollment process report to the Legislature by the Department of Human Services (DHS) and  a county representative appointed by the Association of Minnesota Counties.

Section 7 removes from a rule redundant language regarding transition lenses (another rule specifies that transition lenses are not covered under Medical Assistance).

Section 8 requires the Commissioner of Human Services to seek a Medicaid state plan amendment for the family planning services covered under Minnesota Statutes, section 256B.78.

Section 9 instructs the Office of the Revisor of Statutes to remove cross-references to repealed sections and rules.

Section 10 repeals Minnesota Statutes, section 256.01, subdivision 32 (review and evaluation of ongoing studies);

Repeals Minnesota Rules, parts 9500.1126 (recapture of depreciation); part 9500.1450, subpart 3 (geographic areas for PMAP); 9500.1452, subpart 3 (exclusion during phase-in); 9500.1456 (identification of enrollees); and 9525.1580 (training and habilitation services under the repealed Chapter 245B); Minnesota Rules, parts 9505.5300; 9505.5305; 9505.5310; 9505.5315; and 9505.5325 (related to the family planning services change).
