Article 1

Article 1 makes a number of technical changes to the Health Care Administrative Simplification Act.

Section 1 (62J.50, subd. 1) modifies the citation to simply refer to the Minnesota Health Care Administrative Simplification Act.

Section 2 (62J.50, subd. 2) updates a reference to the Centers for Medicare and Medicaid Services.

Section 3 (62J.51) modifies the definition section by removing references to Category I and Category II industry participants; adds reference to federal regulations where appropriate; removes sate references; removes definitions that refer to NCPDP format 2.0; and removes the definition of a uniform remittance advice report.

Section 4 (62J.52) adds references to the most current version of the uniform billing forms and removes obsolete language.

Section 5 (62J.53) removes references to Category I and II in terms of group purchasers.

Section 6 (62J.535) updates the electronic claims transactions by striking obsolete language and clarifying that group purchasers that are not defined as covered entities may require additional information associated worth a claim submitted by a provider if authorized by state law or rule.

Section 7 (62J.536, subd. 2) makes a technical reference change.

Sections 8, 9, and 10 (62J.54) removes obsolete effective date references and add references to the appropriate federal regulations.

Section 11 (62J.56, subd. 1) removes references to granting an exemption to Category I and II participants.

Section 12 (62J.56, subd. 2) removes references to Category I and II industry participants and core transaction sets.  Also removes a reference to the health data institute.

Section 13 (62J.56, subd. 3) changes a reference to the National Uniform Claim Committee.

Sections 14, 15, and 16 (62J.581) change references regarding a remittance advice report to a uniform claim payment/advice transaction.  Correct a statutory citation and remove an obsolete exemption.

Section 17 (62J.61) makes a technical statutory citation change.

Section 18 instructs the Revisor to make changes regarding the repealed section.

Section 19 repeals section 62J.59 (NCPDP telecommunications standard for pharmacy claims).

Article 2

Article 2 makes a number of technical and other changes to the vulnerable adults maltreatment reports.

Section 1 (626.557, subd. 12b) changes the requirement that the commissioners of health and human services annually report to the legislature and governor on the number and type of reports of alleged maltreatment involving licensed facilities reported, the number of those reports requiring investigations, and the resolution of those investigations to requiring the commissioner to publish the report on their Web site and on a biennial basis report to the legislature and governor on the following (1) number and type of reports of alleged maltreatment involving licensed facilities reported under this section, the number requiring an investigation, the resolution of those investigations, and which agency was responsible; (2) trends about types of maltreatment found; (3) if there are upward trends for types of maltreatment; (4) efforts to improve protection of vulnerable adults; (5) whether there are backlogs of cases and recommendations for reducing backlogs if applicable; (6) recommended changes to statutes affecting the protection of vulnerable adults; and (7) and other information that is relevant to the report trends and findings.

Article 3

Article 3 makes technical changes to the tuberculosis statutes.

Section 1 (122A.40, subd. 12) removes a specific reference to active tuberculosis.

Section 2 (122A.41, subd. 6) removes a specific reference to active tuberculosis.

Section 3 (154.25) removes reference to tuberculosis.

Section 4 instructs the Revisor to make changes regarding the repealed sections.

Section 5 repeals sections 144.443 (tuberculosis health threat); 144.444 (tuberculosis emergency hold); and 144.45 (tuberculosis in schools).

Article 4

Article 4 makes changes to the formaldehyde sections.

Section 1 instructs the Revisor to make changes regarding the repealed sections.

Section 2 repeals sections 144.495 (formaldehyde rules) and 325.181 (formaldehyde product standards).

Article 5

Article 5 makes other technical changes.

Section 1 (144.12, subd. 1) changes Board of Health to community health; corrects a statutory citation; and strikes from the list of public health rules the furnishing of vaccine matter.

Section 2 instructs the Revisor to make changes regarding the repealed sections.

Section 3 repeals sections 62J.322 (provider information pilot study); 62U.09 (health care reform review council); 144.011, subd. 2 (state health advisory task force); 144.0506 (information to be posted on the Department of Health’s Web site); 144.071 (merit system for local employees); 144.072 (implementation of the social security amendments of 1972); 144.076 (mobile health clinic); 144.146 (treatment program of cystic fibrosis); 144.1475 ( rural hospital demonstration project); 145.132 (removal of brain); 145.97 (Hill Burton program record keeping); and 145.98 (council on health promotion and wellness).
