Section 1 provides that if the court finds that a party does not meet the criteria to qualify for in forma pauperis, but is still unable to pay all of the court fees and costs, the court may order a partial payment of $75.  In addition, the section contains a clarification of the definition of “public assistance” by referencing the definition used in Minnesota Statutes, section 550.37, subidivision 14, relating to property exempt from attachment or garnishment by the court.

Section 2 provides the court the authority to order reimbursement of all or a portion of the fees and costs incurred by the party who qualifies for in forma pauperis if the party no longer meets the eligibility criteria or the party is able to pay an amount higher than the $75 partial payment referenced in section 1.
