 Section 1 (256B.056, subdivision 4) modifies Medical Assistance (MA) eligibility requirements for adults and children with disabilities and individuals 65 years of age or older. The eligibility changes include raising income levels from 100 to 133 percent of the federal poverty guidelines (FPG), and using the modified adjusted gross income (MAGI) methodology under the Affordable Care Act to calculate income. The section is effective January 1, 2014.

Section 2 (256B.056, subdivision 5c) modifies, beginning January 1, 2014, the excess income standard for people on MA from 75 to 133 percent of the FPG, uses MAGI to determine income, and removes obsolete language.

Section 3 requires the Department of Human Services (DHS) to consult with stakeholders to develop recommendations and request a federal 1115 demonstration waiver to increase the asset limit for individuals on MA not living in institutions. The recommendations are due to the Legislature by February 1, 2014.

Section 4 requires DHS to seek from the federal government authority to allow individuals under 65 years of age receiving home and community-based services (HCBS) waivers to continue using the income and asset disregard for the spouse not on a HCBS waiver, instead of the impoverishment provisions under the Affordable Care Act.
