Section 1 amends current law relating to interim rates that may be charged by utilities.  “Interim rates’ are the rates that are charged after a filing for new rates with the Public Utilities Commission (PUC) and before the final decision on new rates.  Section 1 makes the granting of interim rates dependent on a PUC finding that an immediate and compelling necessity exists for an interim rate increase.  The current law provides that the PUC shall order an interim rate within 60 days of a rate filing.

An interim rate is limited to that necessary to prevent injury to the public or utility, not exceeding the amount requested by the utility.  Current rate components that are required to be included in an interim rate are made discretionary with the PUC.
