Senate File 845 is the Governor’s budget bill for agriculture agencies.  This is a summary of the statutory sections that starts with Section 6 of the bill.

Section 6 [Federal funds] clarifies that federal funds received by the Commissioner of Agriculture may be paid pursuant to applicable federal provisions.

Section 7 [Promotional expenditures] clarifies that the Commissioner of Agriculture may spend money appropriated for promotional expenditures in the same manner that partner organizations make expenditures for those purposes.

Section 8 [Commercial animal waste technician]

            Subdivision 1 [Requirement] recodifies and clarifies current exemptions from the requirement to be licensed as a commercial animal waste technician.  Under the change, a person who applies animal waste for hire must have:

  1. A commercial animal waste technician applicator license;
  2. A commercial animal waste technician site manager license; or
  3. A commercial animal waste technician company license and a commercial animal waste technical site manager that is employed by the entity.

A commercial animal waste technician applicator must have a minimum of two hours of certification training and may only apply animal waste for hire under the direct supervision of a commercial animal waste technician site manager.  A person applying animal waste on land managed by the person’s employer is exempt from license requirements.

            Subdivision 3 [License] makes the license term one year and requires the commercial animal waste technician company license number on equipment used for commercial animal waste application.

            Subdivision 4 [Technical] updates this section to reflect the new license categories and the name of the University of Minnesota Extension.

            Subdivision 5 [Renewal application] provides that a person who meets renewal requirements by reexamination, instead of attending workshops, must pay a fee for renewal.

            Subdivision 7 [Application fee] establishes the fee for a commercial animal waste technician applicator at $25 and the commercial animal waste technician site manager at $50. The application fee for a commercial animal waste technician company license is $100.

Section 9 [Technical] updates the requirement for feedlots over 300 animal units without an updated manure management plan to include the new commercial animal waste technician licensing categories.
