Section 1 [325F.174] [Definitions] provides definitions of “child” and “children’s product.”  “Child” applies to persons under 12 years of age.  “Children’s products” excludes food, beverages, dietary supplements, or defined medical devices.

Section 2 [325E.175] [Formaldehyde in children’s products; ban] beginning January 1, 2014, prohibits manufacturers from knowingly selling or offering for initial retail sale children’s products that contain formaldehyde or ingredients that release formaldehyde when chemically degraded.

Section 3 [325E.176] [Formaldehyde replacement chemicals] prohibits manufacturer from replacing formaldehyde in a children’s product with a chemical known to the manufacturer to have been identified as a chemical of high concern by a state, federal, or international agency as being known or suspected to:  (1) harm the normal development of a fetus or child; (2) cause cancer, genetic damage, or reproductive harm; (3) disrupt the endocrine or hormone system; or (4) damage the nervous system, immune system, or organs.  Makes this section effective August 1, 2013, and applies to crimes committed on or after that date.
