Section 1 amends a special law that allows the Minneapolis Park and Recreation Board (“Board”) and the Minneapolis City Council (“City”) to jointly require public land dedication or dedication fees. The Board and City may impose the dedication or dedication fee in conjunction with a construction permit. The cash fee may be set at a flat rate per new residential unit. The bill also removes the reference to general law regarding subdivision regulation.
This section is effective the day after final enactment and applies to ordinances adopted by the Minneapolis Park and Recreation Board before, on, or after that date.
Section 2 is a special law that allows St. Paul to adopt an ordinance to require a reasonable portion of land be dedicated to the public or to impose a dedication fee. The dedication or dedication fee is to be imposed in conjunction with construction permits for new housing units and new commercial and industrial development. The dedication or fee is for parks, playgrounds, recreational facilities, wet lands, trails, or open space. The fee may be set at a flat rate per net new residential unit. Senior housing and affordable housing may be excluded. Specified provisions, including the nexus requirement, of general dedication law apply.
This section is effective the day after enactment and applies to ordinances adopted or amended before, on, or after that date.
