Section 1.  Partisan office.  This section amends the current law to apply only to partisan offices.

Section 2.  Nonpartisan office.  This section creates a new subdivision on vacancies in nomination in nonpartisan offices.  Lines 1.16 to 1.19 are substantively the same as the current law.  Lines 1.20 and 1.21 provide for new language that applies when a candidate for a nonpartisan office, other than a judicial office, dies more than 84 days before the general election. 

Section 3.  Effective date. This act is effective the day following final enactment.

Background:  This bill addresses an issue raised in the 2012 Rochester City Council election.  The Rochester City Council president filed for re-election but passed away after the withdrawal period had ended.  The current law does not allow for a vacancy in nomination when a candidate for a nonpartisan office dies regardless of the timing, so the City Council President’s name remained on the ballot.
