Section 1 [Permanent Total Disability] prevents certain reductions to workers' compensation permanent total disability benefits.  Currently, a worker's compensation permanent total disability benefit is reduced, after receipt of $25,000 in workers' compensation benefit payments, if another government source of disability benefit is available.  This section prevents payments under the Public Employees Retirement Association police and fire plan for total and permanent duty disability benefit from reducing the workers' compensation benefit.

This section is effective the day following final enactment and applies to all future payments to members of the Public Employees Retirement Association police and fire plan, regardless of the date of injury.

Section 2 [Benefits paid under workers' compensation law] makes a conforming change to the Public Employees Retirement Association in Chapter 353.

Section 3 [Provisions not severable] clarifies that the provisions of this act are not severable.
