Section-by-Section Summary
Section 1 [Legal Fees Related to Exit Polling Restrictions Statute.] As amended by the Author’s A-1 amendment, this section appropriates $149,000 in fiscal year 2011 to pay an award of attorney fees imposed on the state by the Federal District Court in Minnesota in a lawsuit filed against the Secretary of State challenging the constitutionality of Minnesota Statutes, section 204C.06, subdivision 1. As challenged, section 204C.06, subdivision 1, prevented individuals from lingering within 100 feet of a polling place. This section in law was amended by Laws 2010, Chapter 201, section 35, to include an exemption from the prohibition on lingering near a polling place for individuals who are conducting exit polling.
Section 2 appropriates $322,000 from the general fund to the Secretary of State in fiscal year 2011 for payments to counties to reimburse costs incurred by the counties during the conduct of the recount for the gubernatorial election in 2010. A portion of this appropriation is also for payment to the Secretary of State for costs already reimbursed to the counties.
