This bill modifies the nursing facility rate equalization provision by allowing private pay rate increases by two percent above Medical Assistance (MA) rates from July 1, 2012, to September 30, 2013. Beginning October 1, 2013, and every year in perpetuity, rates may increase by two percent above those in existence for private paying residents on September 30.

Additionally, it clarifies that for residents on MA, MA rate payments must be accepted as payment in full for services included in the daily rate for continued stay.
