Author: Senator Doug Magnus

Prepared By:

Date: February 15, 2012

SF 1635 recodifies and extends the current seasonal exception (October 1 to March 31) from the minimum biodiesel requirements for Number 1 diesel fuel.  The bill extends this seasonal exception for Number 1 diesel fuel and other current exceptions until May 1, 2015.  The current exception for seasonal Number 1 diesel fuel was in an uncodified 2010 law (Laws 2010, chapter 228, section 4), which reads:

“ Sec. 4. EXTENSION OF COMMISSIONER'S ORDER.
The order by the commissioner of commerce exempting number 1 diesel fuel from
the biodiesel content requirements under Minnesota Statutes, section 239.77, subdivision 2, paragraph (a), is extended until March 31, 2012, for the months of October, November, December, January, February, and March.
