OVERVIEW
This bill requires the Legislative Commission on Planning and Fiscal Policy (LCPFP) to prepare fiscal notes and revenue estimates, local impact notes regarding pending legislation, and to prepare forecasts of state revenues and expenditures. The bill removes these duties from the Commissioner of Management and Budget and transfers appropriations from Management and Budget to the Legislature for the additional duties assigned to the LCPFP.
Section-By-Section Summary
Section 1, subdivision 1 [Membership.] changes the membership of the LCPFP to include 12 legislative members appointed as follows:
- three members appointed by the Senate Subcommittee on Committees;
- three members appointed by the Senate minority leader;
- three members appointed by the speaker of the House of Representatives; and
- three members appointed by the Senate minority leader.
(Current law provides 18 legislative members for the LCPFP, with nine from each chamber and no specification for minority caucus appointments.)
Subdivision 4 [Agencies to cooperate.] specifies that LCPFP staff may assist with the additional duties assigned to the LCPFP in this bill.
Subdivision 5 [Duties.] requires the LCPFP to prepare fiscal notes, revenue eestimates, local government impact notes, and to forecast state revenues and expenditures.
Subdivision 5a [Staff; contracts for service.] requires the LCPFP to hire an executive director and allows the legislative bodies to transfer employees to the commission.
Subdivision 5b [Advisory group.] authorizes the LCPFP to appoint a council of unpaid outside experts to assist and advise the council.
Section 2 [Fiscal Notes.] amends existing law requiring the preparation of fiscal notes to specify that the LCPFP will prepare fiscal notes and that departments and agencies within state government must provide draft fiscal notes and information regarding fiscal notes upon the request of executive director of the LCPFP.
Section 3 [Appropriation.] provides an unspecified direct appropriation for the 2012-2013 biennium to the Legislative Coordinating Commission for the LCPFP. Also reduces the general fund appropriation to the Department of Management and Budget by an unspecified amount in the 2012-2013 biennium.
Section 4 [Effective Date.] makes the bill effective July 1, 2011, and provides that the duty to prepare fiscal notes does not become effective until February 1, 2012, and the duty to prepare forecast of state revenues and expenditures becomes effective July 1, 2012.
