S.F. No. 1058 - Pickup Trucks Registration and Plates

Author: Senator Michael J. Jungbauer

Prepared By: Krista Boyd, Senate Fiscal Analyst (651/296-7681)

Date: May 3, 2011

Section 1 defines “noncommercial vehicle” in the chapter of statute on vehicle registration, as a one-ton pickup truck that is registered as a truck, has a gross vehicle weight of 15,000 pounds or less, and will be operated exclusively for personal use.

Section 2 defines “one-ton pickup truck” in the chapter of statute on vehicle registration, as any truck resembling a pickup truck that has a rated carrying capacity of one ton.  If the rated carrying capacity is not known, the gross vehicle weight rating must be between 10,001 and 15,000 pounds.

Section 3 amends the definition of “passenger automobile” in the chapter of statute on vehicle registration, removing certain noncommercial pickup trucks or vans.  The provision would now allow registration of pickup trucks or vans as passenger vehicles if they meet the definitions in Sections 4 and 5 of the bill, respectively.

Section 4 amends the definition of “pickup truck” in the chapter of statute on vehicle registration.  Current law defines a pickup truck as a truck with a rated carrying capacity of less than three-fourths ton.  The amended definition would include those pickups with a gross vehicle weight of 10,000 pounds or less when the rated carrying capacity is unknown.

Section 5 amends the definition of “van” in the chapter of statute on vehicle registration.  Current law defines a van as a vehicle of certain design with a rated carrying capacity of less than three-fourths ton.  The amended definition would include those vans with a gross vehicle weight of 10,000 pounds or less when the rated carrying capacity is unknown.

Section 6 amends the description of one-ton pickup trucks in the section of statute on disability license plates, replacing it with a reference to the definition created in Section 2 of the bill.  This section also adds statutory definitional references for motorcycles and recreational vehicles.

Section 7 requires license plates issued to noncommercial vehicles to bear the inscription “noncommercial,” unless the vehicle is displaying an authorized special plate.  The section also specifically allows the display of special plates on one-ton pickup trucks that are used for commercial purposes and that are required to display a USDOT carrier number.

Section 8 adds statutory definitional references for passenger automobiles and recreational vehicles to the section of statute on amateur radio special license plates.

Section 9 amends the description of one-ton pickup trucks in the section of statute on firefighters special license plates, replacing it with a reference to the definition created in Section 2 of the bill.  This section also adds statutory definitional references for passenger automobiles and motorcycles.

Section 10 adds a statutory definitional reference for passenger automobiles to the section of statute on National Guard special license plates.

Section 11 adds a statutory definitional reference for passenger automobiles to the section of statute on Ready Reserve special license plates.
