Section 1 provides that a limitation restricting the right of a residential property owner to install a flagpole to a portion of real property to which the owner has exclusive use is void and unenforceable.
Section 2, subdivision 1, provides that any provision of a homeowner's association governing document that limits the right of an owner to display a noncommercial sign during the election campaign season is void and unenforceable.
Subdivision 2 provides exceptions to the general rule of subdivision 1.
Subdivision 3 gives an owner of residential property the right to recover reasonable attorney fees and expenses if denied the right provided by subdivision 1.
Subdivision 4 provides that this section applies to all limitations prohibited by this section regardless of whether the homeowner's association document was executed or adopted on or before August 1, 2011.
Section 3 provides that fines for violations of the governing documents of a homeowner's association do not become a lien against the property and are not enforceable as assessments, but may be recovered in a civil action.
