Section 1 [Summary of Appropriations] provides a summary of the approximately $79 million in direct appropriations for the next biennium.
Section 2 [Agriculture Appropriations] provides the boilerplate language for the interpretations of the biennial appropriations in the bill.
Section 3 [Department of Agriculture] directly appropriates approximately $64 million to the Department of Agriculture for the next biennium.
Section 4 [Board of Animal Health] directly appropriates approximately $9.7 million for the next biennium.
Section 5 [AURI] directly appropriates approximately $5.3 million to the Agricultural Utilization Research Institute (AURI) for the next biennium.
Section 6 [Farm disposal of solid waste] allows a farmer to bury concrete and reinforcing bar from a building or structure on farmland. These items are added to an existing law that allows a farmer to bury household and farm waste when the farmer does not have regularly scheduled pickup of solid waste. The farmer must record an affidavit of the location of the buried concrete or reinforcing bar with the county recorder.  This is from SF 558 (Rosen).
Section 7 [Terrestrial pesticide applications] clarifies that the commissioner of agriculture has the sole regulatory authority over terrestrial application of pesticides.  This is from SF776 (Rosen).
Section 8 [Anhydrous ammonia definition] defines anhydrous ammonia for the purposes of the fertilizer law. This is a Governor’s recommendation.
Section 9 [Certificate of regulatory compliance] provides for the commissioner of agriculture to certify persons to perform regulatory compliance to persons who store, handle, or distribute anhydrous ammonia. This is a Governor’s recommendation.
Section 10 [Compliance and inspection frequency] allows the commissioner of agriculture to decrease the inspection frequency for a person or site that is issued a certificate of compliance for anhydrous ammonia.  This is a Governor’s recommendation.
Section 11 [ACRRA Surcharge on pesticide sales] eliminates the minimal fee exemption of $10 for sales of agricultural pesticides for the agricultural chemical response and reimbursement account (ACRRA).  This is a Governor’s recommendation.
Section 12 [Wholesale produce dealer account] creates the wholesale produce dealers account in the agricultural fund for the deposit of fees, charges, and penalties from the wholesale produce dealers law.  This is a Governor’s recommendation.
Section 13 [Livestock mortalities] clarifies that the executive director of the Board of Animal Health is responsible for regulating and oversight of the disposal of livestock mortalities.  The board shall consult with the Pollution Control Agency if the disposal could adversely affect ground or surface water.  This is from SF 558 (Rosen).
Section 14 [County agricultural societies; land exchanges] clarifies that a county agricultural society can exchange land owned by the society. This is from SF 260 (Saxhaug).
Section 15 [County fee land; land exchanges] provides that counties may exchange any county-owned land for other land. This section also allows for private appraisal by a licensed appraiser of the lands, and requires public notice in the county auditor’s office and the official county newspaper, and a public hearing prior to the exchange. The process is modeled after the process used for the exchange of tax-forfeited lands, which are owned by the state and managed by the county.  This is from SF 260 (Saxhaug).
Section 16 [Repealer] repeals the ethanol producer payment law on June 30, 2013.
