1.1Senator Limmer moved to amend the A-3 amendment to H.F. No. 4109 as follows:
1.2Page 4, after line 15, insert:

1.3    "Sec. 11. Minnesota Statutes 2022, section 363A.20, subdivision 2, is amended to read:
1.4    Subd. 2. Religious or Fraternal organization. The provisions of section 363A.08 shall
1.5not apply to a religious or fraternal corporation, association, or society, with respect to
1.6qualifications based on religion or sexual orientation, when religion or sexual orientation
1.7shall be is a bona fide occupational qualification for employment.

1.8    Sec. 12. Minnesota Statutes 2022, section 363A.26, is amended to read:
1.9363A.26 EXEMPTION BASED ON RELIGIOUS ASSOCIATION.
1.10Nothing in this chapter prohibits any religious association, religious corporation, or
1.11religious society that is not organized for private profit, or any institution organized for
1.12educational purposes that is operated, supervised, or controlled by a religious association,
1.13religious corporation, or religious society that is not organized for private profit, consistent
1.14with the protections or privileges of the First Amendment of the United States Constitution
1.15and article 1, section 16, of the state constitution, including ministerial exceptions provided
1.16therein, from:
1.17(1) limiting admission to or giving preference to persons of the same religion or
1.18denomination;
1.19(2) in matters relating to sexual orientation, taking any action with respect to education,
1.20employment, housing and real property, or use of facilities. This clause shall not apply to
1.21secular business activities engaged in by the religious association, religious corporation, or
1.22religious society, the conduct of which is unrelated to the religious and educational purposes
1.23for which it is organized; or
1.24(3) taking any action with respect to the provision of goods, services, facilities, or
1.25accommodations directly related to the solemnization or celebration of a civil marriage that
1.26is in violation of its religious beliefs.
1.27This section shall not apply to secular business activities engaged in by the religious
1.28association, religious corporation, religious society, or any institution organized for
1.29educational purposes that is operated, supervised, or controlled by a religious association,
1.30religious corporation, or religious society that is not organized for private profit, the conduct
1.31of which is unrelated to the religious and educational purposes for which it is organized."
2.1Renumber the sections in sequence and correct the internal references
2.2The motion prevailed. #did not prevail. So the amendment to the amendment was #not
2.3adopted.
