2.2CONSTRUCTION.
2.3A person shall not drill, convert under section 103I.601, subdivision 12, or construct
a
2.4gas well for the primary purpose of extracting or producing gas until:
2.5(1) rules are adopted under section 103I.706;
2.6(2) the legislature enacts a statute specifically authorizing the issuance of gas
resource
2.7development permits; and
2.8(3) the legislature enacts fees for gas resource development permits.
2.9 Sec. 14.
[103I.708] WELLS; RESTRICTIONS.
2.10(a) Notwithstanding any provision of chapter 93 or 103I, or the rules adopted thereunder,

2.12(b) Notwithstanding any provision of chapter 93 or 103I, or the rules adopted thereunder,
2.13to the contrary, a person shall not construct a gas well for the primary purpose of
extracting
2.14or producing a gas other than helium. Nothing in this paragraph shall be construed
to prevent:
2.15(1) the drilling or construction of an exploratory boring; or

[103I.709] GAS WELLS; PROHIBITIONS.
2.19 Subdivision 1. Injection prohibited. A gas well must not be used to inject or dispose
2.20surface water, groundwater, or any other liquid, gas, or chemical. This does not prohibit
the
2.21injection:
2.22(1) of approved drilling fluids; or
2.23(2) if a class 2 injection well permit is obtained for a gas well, as authorized by
the
2.24Environmental Protection Agency.
2.25 Subd. 2. Hydraulic fracturing treatment prohibited. Hydraulic fracturing treatment
2.26is prohibited in a gas well."
