[471.372] NONDISCLOSURE AGREEMENTS.
1.4 Subdivision 1. Definitions. (a) For purposes of this section, the following terms have
1.5the meanings given.
1.6(b) "Data center" has the meaning given in section 216B.02, subdivision 11.
1.7(c) "Local government official" means a member of a city council, mayor, county
1.8commissioner, town supervisor, and any other elected official established by a home
rule
1.9charter, or any employee of a city, county, or town.
1.10 Subd. 2. Nondisclosure agreements restricted. (a) A local government official must
1.11not enter into a nondisclosure agreement or other contract restricting public disclosure
of
1.12information about a potential data center development within the boundaries of the
political
1.13subdivision.
1.14(b) Any agreement or contract or term of an agreement or contract that violates paragraph
1.15(a) is void and unenforceable.
1.16(c) When a contract contains a provision that is void and unenforceable under paragraph
1.17(b), that provision must be severed from the other provisions of the contract to the
extent
1.18that it is void and unenforceable. The fact that the provision is void and unenforceable
does
1.19not affect the other provisions of the contract.
1.20(d) If a local government official enters a contract or agreement that violates paragraph
1.21(a), the local government official must publicly disclose the contract or agreement.
1.22EFFECTIVE DATE.This section is effective August 1, 2026, and applies to agreements
1.23entered into on or after that date."
