Approval of cannabis flower and products. (a) For the purposes of
1.14this section, "product category" means a type of product that may be sold in different
sizes,
1.15distinct packaging, or at various prices but is still created using the same manufacturing
or
1.16agricultural processes. A new or additional stock keeping unit (SKU) or Universal
Product
1.17Code (UPC) shall not prevent a product from being considered the same type as another
1.18unit. All other terms have the meanings provided in section
342.01.
1.19(b) The office shall approve product categories of cannabis flower, cannabis products,
1.20lower-potency hemp edibles, and hemp-derived consumer products for retail sale.
1.21(c) The office
may establish must enforce limits on the total THC
of contained in cannabis
1.22flower,
cannabis concentrate, topical or transdermal cannabis products
and topical or
1.23transdermal hemp products, and hemp-derived consumer products. As used in this paragraph,
1.24"total THC" means the sum of the percentage by weight of tetrahydrocannabinolic acid
1.25multiplied by 0.877 plus the percentage by weight of all tetrahydrocannabinols.
The office
1.26must enforce the following THC content limits:
1.27(1) cannabis flower marketed for sale in the adult-use market must not contain more
1.28than 15 percent total THC;
1.29(2) cannabis concentrate, either liquid or solid, marketed for sale in the adult-use
market
1.30must not contain more than 30 percent total THC; and
2.1(3) topical or transdermal cannabis products and topical or transdermal hemp products
2.2marketed for sale must not contain more than 500 milligrams of total THC per package.
2.3(d) The office must not approve the following for sale in the adult-use market:
2.4(1) cannabis flower that have been infused with additional THC or other psychoactive
2.5cannabinoids; or
2.6(2) prerolls, as defined in section 342.01, subdivision 61a, that have been infused
with
2.7additional THC or other psychoactive cannabinoids.
2.8(d) (e) The office shall not approve any cannabis product, lower-potency hemp edible,
2.9or hemp-derived consumer product that:
2.10(1) is or appears to be a lollipop
or, ice cream
, a pastry, candy, or a chocolate confection;
2.11(2) bears the likeness or contains characteristics of a real or fictional person,
animal, or
2.12fruit;
2.13(3) is modeled after a type or brand of products primarily consumed by or marketed
to
2.14children;
2.15(4) is substantively similar to a meat food product; poultry food product as defined
in
2.16section
31A.02, subdivision 10; or a dairy product as defined in section
32D.01, subdivision
2.177;
2.18(5) contains a synthetic cannabinoid;
2.19(6) is made by applying a cannabinoid, including but not limited to an artificially
derived
2.20cannabinoid, to a finished food product that does not contain cannabinoids and is
sold to
2.21consumers, including but not limited to a candy or snack food; or
2.22(7) if the product is an edible cannabis product or lower-potency hemp edible, contains
2.23an ingredient, other than a cannabinoid, that is not approved by the United States
Food and
2.24Drug Administration for use in food."
