[201.143] CITIZENSHIP; REGISTRATION STATUS.
1.4 Subdivision 1. Registration status. (a) Upon receiving documentary proof or verified
1.5information that an individual who is registered or preregistered to vote is not a
United
1.6States citizen, the county auditor must immediately challenge the status of the individual's
1.7record in the statewide voter registration system. If documentary proof or verified
information
1.8about an individual is provided to the secretary of state, the secretary of state
must
1.9immediately forward the proof or information to the county auditor of the county where
the
1.10individual is registered or preregistered and the county auditor must immediately
challenge
1.11the individual's status.
1.12(b) Within five days of challenging the individual's registration, the county auditor
must
1.13mail a notification of the status change to the individual. The notification must
include a
1.14statement that the individual may register to vote again by completing a voter registration
1.15application and providing a document listed in subdivision 2 that proves citizenship.
1.16(c) At least monthly, each county auditor must report to the secretary of state on
the
1.17number of individuals whose status was challenged pursuant to this section. For each
1.18individual, the auditor must specify the method of registration used. By January 15
of each
1.19year, the secretary of state must report to the chairs of the legislative committees
with
1.20jurisdiction over elections on individuals whose status was challenged pursuant to
this
1.21section. The report must include information from each county, including the number
of
1.22individuals whose status was challenged in each county each month and the method of
1.23registration for each individual.
1.24 Subd. 2. Citizen documents. An individual may prove citizenship for purposes of
1.25subdivision 1 by providing the following document or documents:
1.26(1) a form of identification issued consistent with the requirements of the REAL ID
Act
1.27of 2005 that indicates the applicant is a citizen of the United States;
1.28(2) a valid United States passport;
1.29(3) the applicant's official United States military identification card, together
with a
1.30United States military record of service showing that the applicant's place of birth
was in
1.31the United States;
2.1(4) a valid government-issued photo identification card issued by a federal, state,
or
2.2Tribal government showing that the applicant's place of birth was in the United States;
or
2.3(5) a valid government-issued photo identification card issued by a federal, state,
or
2.4Tribal government other than an identification described in clauses (1) to (4), but
only if
2.5presented together with one or more of the following:
2.6(i) a certified birth certificate issued by a state, a unit of local government in
a state, or
2.7a Tribal government which:
2.8(A) was issued by the state, unit of local government, or Tribal government in which
2.9the applicant was born;
2.10(B) was filed with the office responsible for keeping vital records in the state;
2.11(C) includes the full name, date of birth, and place of birth of the applicant;
2.12(D) lists the full names of one or both of the parents of the applicant;
2.13(E) has the signature of an individual who is authorized to sign birth certificates
on
2.14behalf of the state, unit of local government, or Tribal government in which the applicant
2.15was born;
2.16(F) includes the date that the certificate was filed with the office responsible for
keeping
2.17vital records in the state; and
2.18(G) has the seal of the state, unit of local government, or Tribal government that
issued
2.19the birth certificate;
2.20(ii) an extract from a United States hospital Record of Birth created at the time
of the
2.21applicant's birth which indicates that the applicant's place of birth was in the United
States;
2.22(iii) a final adoption decree showing the applicant's name and that the applicant's
place
2.23of birth was in the United States;
2.24(iv) a Consular Report of Birth Abroad of a citizen of the United States or a certification
2.25of the applicant's Report of Birth of a United States Citizen issued by the secretary
of state;
2.26(v) a Naturalization Certificate or Certificate of Citizenship issued by the Secretary
of
2.27Homeland Security or any other document or method of proof of United States citizenship
2.28issued by the federal government pursuant to the Immigration and Nationality Act;
or
2.29(vi) an American Indian Card issued by the Department of Homeland Security with the
2.30classification "KIC.""
