1.3 "Sec. 2.
[3.0845] FINANCIAL INTERESTS OF LEGISLATORS AND STAFF.
1.4 Subdivision 1. Definitions. (a) For the purposes of this section, the following terms have
1.5the meanings given.
1.6(b) "Compensation" means anything of value that is not a gift under section 10A.071.
1.7(c) "Designated legislative staff" means the secretary of the senate for reports from
1.8senators and senate staff, and the chief clerk of the house of representatives for
members
1.9and staff of the house of representatives.
1.10(d) "Family member" means a spouse, child, stepchild, sibling or sibling's spouse,
mother,
1.11father, stepmother, or stepfather, or person who maintains a permanent residence at
the
1.12legislator's homestead property.
1.13(e) "Grant" means a transfer of cash or something of value to a recipient to support
a
1.14public purpose authorized by law.
1.15 Subd. 2. Financial disclosure required. A legislator must report to designated legislative
1.16staff if the legislator or a family member of the legislator receives compensation
from an
1.17entity that is seeking state funding through a grant that is the subject of a bill
that has been
1.18introduced in either body of the legislature. The report must be made within five
days of
1.19the date the bill is introduced in the senate or house of representatives, and before
action is
1.20taken on the bill by a legislative committee or by the senate or the house of representatives.
1.21The designated legislative staff must promptly notify the author of the bill and the
chair and
1.22ranking minority member of any committee to which the bill has been referred or rereferred
1.23regarding the reported compensation. The designated legislative staff must post all
disclosures
1.24under this subdivision on the website for the senate or house of representatives,
as applicable.
1.25 Subd. 3. Preclusion on certain outside employment. A person employed by the house
1.26of representatives, the senate, or a joint office of the legislature is prohibited
from accepting
1.27compensation from an entity that makes a request for funding through a bill authored
by a
1.28legislator or through a grant request or response to a request for proposal to a state
agency
1.29or constitutional officer. A violation of this subdivision is grounds for discipline,
up to and
1.30including dismissal.
1.31 Subd. 4. Relationship to other requirements. The requirements and prohibitions under
1.32this section are in addition to the conflict of interest requirements under section
10A.07,
2.1the representation disclosure requirements under section 10A.08, and the requirement
to
2.2file a statement of economic interest under section 10A.09."
