1.3    "Sec. 13. [471.372] NONDISCLOSURE AGREEMENTS.
1.4    Subdivision 1. Definitions. (a) For purposes of this section, the following terms have
1.5the meanings given.
1.6(b) "Data center" means a facility comprised of one or more buildings that has a primary
1.7purpose of providing for the storage, management, or processing of digital data.
1.8(c) "Municipality" means a county, home rule charter or statutory city, or town.
1.9    Subd. 2. Nondisclosure agreements restricted. (a) A municipality must not enter into
1.10a nondisclosure agreement or other contract restricting local officials or other representatives
1.11of the municipality from disclosing information about a potential data center development
1.12in the municipality to members of the public.
1.13(b) Any agreement or contract or term of an agreement or contract that violates paragraph
1.14(a) is void and unenforceable.
1.15(c) When a contract contains a provision that is void and unenforceable under paragraph
1.16(b), that provision must be severed from the other provisions of the contract to the extent
1.17that it is void and unenforceable. The fact that the provision is void and unenforceable does
1.18not affect the other provisions of the contract.
1.19(d) A municipality must publicly disclose any contract or agreement that it has entered
1.20into that violates paragraph (a) by posting the agreement on its website.
1.21    Subd. 3. Applicability. This section applies to agreements in force on or after August
1.221, 2025.
1.23EFFECTIVE DATE.This section is effective on August 1, 2025, and applies to contracts
1.24in force on or after the effective date."
