1.1Senator Nelson moved to amend H.F. No. 5247, as amended pursuant to Rule 45,
1.2adopted by the Senate May 6, 2024, as follows:
1.3(The text of the amended House File is identical to S.F. No. 5234.)
1.4Page 134, after line 8, insert:

1.5    "Sec. 4. Minnesota Statutes 2023 Supplement, section 349.12, subdivision 12b, is amended
1.6to read:
1.7    Subd. 12b. Electronic pull-tab device. (a) "Electronic pull-tab device" means a handheld
1.8and portable electronic device that:
1.9(1) is used to play one or more electronic pull-tab games;
1.10(2) requires coded entry to activate play but does not allow the use of coin, currency, or
1.11tokens to be inserted to activate play;
1.12(3) requires that a player must individually activate or individually open each electronic
1.13pull-tab ticket and each individual line, row, or column of each electronic pull-tab ticket;
1.14(4) maintains information pertaining to accumulated win credits that may be applied to
1.15games in play or redeemed upon termination of play;
1.16(5) has no spinning reels or other representations that mimic a video slot machine;
1.17(6) has no additional function as a gambling device other than as an electronic-linked
1.18bingo game played on a device defined under section 349.12, subdivision 12a;
1.19(7) may incorporate an amusement game feature as part of the pull-tab game but may
1.20not require additional consideration for that feature or award any prize, or other benefit for
1.21that feature;
1.22(8) may have auditory or visual enhancements to promote or provide information about
1.23the game being played, provided the component does not affect the outcome of a game or
1.24display the results of a game;
1.25(9) maintains, on nonresettable meters, a printable, permanent record of all transactions
1.26involving each device and electronic pull-tab games played on the device;
1.27(10) is not a pull-tab dispensing device as defined under subdivision 32a; and
1.28    (11) has the capability to allow use by a player who is visually impaired.
1.29    (b) An electronic pull-tab device must not include representations that mimic the display
1.30or user interface of a video slot machine by requiring a player to manually activate the reveal
2.1or result of each single row of symbols with a separate and distinct action for each electronic
2.2pull-tab ticket.
2.3EFFECTIVE DATE.This section is effective for games approved after August 1, 2024.

2.4    Sec. 5. Minnesota Statutes 2023 Supplement, section 349.12, subdivision 12c, is amended
2.5to read:
2.6    Subd. 12c. Electronic pull-tab game. (a) "Electronic pull-tab game" means a pull-tab
2.7game containing:
2.8(1) facsimiles of pull-tab tickets that are played on an electronic pull-tab device;
2.9(2) a predetermined, finite number of winning and losing tickets, not to exceed 7,500
2.10tickets;
2.11(3) the same price for each ticket in the game;
2.12(4) a price paid by the player of not less than 25 cents per ticket;
2.13(5) tickets that are in conformance with applicable board rules for pull-tabs;
2.14(6) winning tickets that comply with prize limits under section 349.211;
2.15(7) a unique serial number that may not be regenerated;
2.16(8) an electronic flare that displays the game name; form number; predetermined, finite
2.17number of tickets in the game; and prize tier; and
2.18(9) no spinning reels or other representations that mimic a video slot machine, including
2.19but not limited to free plays, bonus games, screens, or game features that are triggered after
2.20the initial symbols are revealed that display the results of the game;
2.21(10) a mechanism requiring a player to manually activate each electronic pull-tab ticket
2.22to be opened; and
2.23(11) a mechanism requiring a player to manually activate the reveal of each single row
2.24of symbols with a separate and distinct action.
2.25    (b) Each electronic pull-tab game shall include a certification from a board-approved
2.26testing laboratory that the game and device meets the standards and requirements established
2.27in Minnesota Statutes and Minnesota Rules and is in conformance with game procedures
2.28provided by the manufacturer.
2.29EFFECTIVE DATE.This section is effective for games approved after August 1, 2024.

3.1    Sec. 6. Minnesota Statutes 2023 Supplement, section 349.151, subdivision 4d, is amended
3.2to read:
3.3    Subd. 4d. Electronic pull-tab devices and electronic pull-tab game system. (a) The
3.4board may adopt rules it deems necessary to ensure the integrity of electronic pull-tab
3.5devices, the electronic pull-tab games played on the devices, and the electronic pull-tab
3.6game system necessary to operate them.
3.7(b) The board may not require an organization to use electronic pull-tab devices.
3.8(c) Before authorizing the lease or sale of electronic pull-tab devices and the electronic
3.9pull-tab game system, the board shall examine electronic pull-tab devices allowed under
3.10section 349.12, subdivision 12b. The board may contract for the examination of the game
3.11system and electronic pull-tab devices and may require a working model to be transported
3.12to locations the board designates for testing, examination, and analysis. The manufacturer
3.13must pay all costs of any testing, examination, analysis, and transportation of the model.
3.14The system must be approved by the board before its use in the state and must have the
3.15capability to permit the board to electronically monitor its operation and internal accounting
3.16systems.
3.17(d) The board may require a manufacturer to submit a certificate from an independent
3.18testing laboratory approved by the board to perform testing services, stating that the
3.19equipment has been tested, analyzed, and meets the standards required in this chapter and
3.20any applicable board rules.
3.21(e) The board, or the director if authorized by the board, may require the deactivation
3.22of an electronic pull-tab device for violation of a law or rule and to implement any other
3.23controls deemed necessary to ensure and maintain the integrity of electronic pull-tab devices
3.24and the electronic pull-tab games played on the devices.
3.25(f) The board, or the director if authorized by the board, may remove any electronic
3.26pull-tab device that does not conform to the requirements of section 349.12, subdivision
3.2712b, and any electronic pull-tab device containing games that do not conform to the
3.28requirements of section 349.12, subdivision 12c, from the inventories of distributors and
3.29organizations.
3.30EFFECTIVE DATE.This section is effective for games approved after August 1, 2024.

3.31    Sec. 7. REPEALER.
3.32Minnesota Statutes 2023 Supplement, section 349.12, subdivision 25e, is repealed.
4.1EFFECTIVE DATE.This section is effective for games approved after August 1,
4.22024."
