1.1Senator Gruenhagen moved to amend H.F. No. 4757, the first unofficial engrossment,
1.2as follows:
1.3Page 14, after line 26, insert:

1.4    "Sec. 10. Minnesota Statutes 2023 Supplement, section 152.0264, subdivision 1, is amended
1.5to read:
1.6    Subdivision 1. Sale of cannabis in the first degree. An adult is guilty of the sale of
1.7cannabis in the first degree and may be sentenced to imprisonment for not more than five
1.8years or to payment of a fine of not more than $10,000, or both, if the adult:
1.9(1) unlawfully sells more than two ounces of cannabis flower; more than eight grams
1.10of cannabis concentrate; or edible cannabis products, lower-potency hemp edibles, or
1.11hemp-derived consumer products infused with more than 800 milligrams of
1.12tetrahydrocannabinol:
1.13(1) to a minor and the defendant is more than 36 months older than the minor;
1.14(2) (i) within ten years of two or more convictions under subdivision 2 or 3; or
1.15(3) (ii) within ten years of a conviction under this subdivision; or
1.16(2) unlawfully sells cannabis flower, cannabis concentrate, edible cannabis products,
1.17lower-potency hemp edibles, or hemp-derived consumer products to a person under the age
1.18of 21 and the defendant is more than 36 months older than the other person.
1.19EFFECTIVE DATE.This section is effective August 1, 2024, and applies to crimes
1.20committed on or after that date.

1.21    Sec. 11. Minnesota Statutes 2023 Supplement, section 152.0264, subdivision 2, is amended
1.22to read:
1.23    Subd. 2. Sale of cannabis in the second degree. An adult is guilty of sale of cannabis
1.24in the second degree and may be sentenced to imprisonment for not more than 364 days or
1.25to payment of a fine of not more than $3,000, or both, if the adult:
1.26(1) unlawfully sells more than two ounces of cannabis flower; more than eight grams
1.27of cannabis concentrate; or edible cannabis products, lower-potency hemp edibles, or
1.28hemp-derived consumer products infused with more than 800 milligrams of
1.29tetrahydrocannabinol:
1.30(i) in a school zone, a park zone, or a drug treatment facility; or
2.1(ii) within ten years of a conviction under subdivision 1, 2, or 3; or
2.2(2) unlawfully sells cannabis flower, cannabis concentrate, edible cannabis products,
2.3lower-potency hemp edibles, or hemp-derived consumer products to a minor person under
2.4the age of 21.
2.5EFFECTIVE DATE.This section is effective August 1, 2024, and applies to crimes
2.6committed on or after that date."
2.7Renumber the sections in sequence and correct the internal references
2.8Amend the title accordingly
