1.1Senator Dibble moved to amend H.F. No. 4293, as amended pursuant to Rule 45,
1.2adopted by the Senate April 28, 2022, as follows:

1.4Page 177, after line 24, insert:

1.5    "Sec. 11. ASSESSMENT YEAR 2022; REASSESSMENT OF CERTAIN PROPERTY.
1.6(a) By January 1, 2023, the Minneapolis City Assessor or the Hennepin County Assessor
1.7shall reassess property identified as the Cedar Isles Condominium buildings, located at 3141
1.8and 3151 Dean Court, Minneapolis, Hennepin County, including each individual unit within
1.9the property. The reassessment shall take into consideration any valuation change resulting
1.10from damage to the property and each individual unit attributable to or related to the
1.11construction of the Green Line Extension light rail transit line, also known as Southwest
1.12Light Rail.
1.13(b) By January 1, 2023, the city or county assessor shall mail to each property owner an
1.14updated valuation notice, as required under Minnesota Statutes, section 273.121.
1.15EFFECTIVE DATE.This section is effective the day following final enactment.

1.16    Sec. 12. CEDAR ISLES CONDOMINIUM DAMAGES.
1.17    Subdivision 1. Definitions. (a) The following terms have the meanings give for purposes
1.18of this section.
1.19(b) "Cedar Isles Condominiums" are the condominium buildings located at 3141 and
1.203151 Dean Court, Minneapolis, Hennepin County.
1.21(c) "Council" means the Metropolitan Council.
1.22(d) "Southwest Light Rail" means the Green Line Extension light rail transit line.
1.23    Subd. 2. Requirements. (a) The council must ensure that Southwest Light Rail
1.24construction will not cause further damages to Cedar Isles Condominium and that each unit
1.25continues to be safe for occupancy. The council must provide to the Cedar Isles
1.26Condominium Association, in writing, a plan for ensuring no future damages will occur to
1.27the property. The plan must include a process for residents of the Cedar Isles Condominiums
1.28to raise issues related to property damage or safety and the plan for the Council to address
1.29the issues.
1.30(b) The council must repair all existing and future damage to the Cedar Isles
1.31Condominiums that is attributable to or caused by construction of Southwest Light Rail.
2.1The council must enter into a contract with a third party to provide the repairs. The council
2.2must consult with the Cedar Isles Condominiums Association when selecting the third party.
2.3(c) The council must provide compensation to the owner or owners of each unit of the
2.4Cedar Isles Condominiums for the devaluation of their property. The Cedar Isles
2.5Condominium Association must determine an amount for each unit that is equal to the loss
2.6in value of the unit based on damage attributable to or caused by construction of the
2.7Southwest Light Rail.
2.8(d) The council must reimburse the Cedar Isles Condominium Association for all
2.9engineering and legal costs incurred by the association in engaging a peer review of the
2.10council's findings related to damages of the condominiums.
2.11(e) The council must provide office space for any resident of the Cedar Isles
2.12Condominiums who would work from home if not for interruptions from Southwest Light
2.13Rail construction. The council must provide office space to any resident who requests an
2.14off-site office. The office space must be located within one mile of the condominium
2.15buildings and must provide individual office space equipped with furniture and access to
2.16phone and internet. The council must not impose any fee.
2.17(f) The council must pay for all costs incurred pursuant to this section from the southwest
2.18light rail project budget. State funds must not be used to pay for any costs incurred pursuant
2.19to this section.
2.20EFFECTIVE DATE.This section is effective the day following final enactment."
