1.2adopted by the Senate April 30, 2025, as follows (...):

1.4Page 126, after line 15, insert:

1.5    "Sec. 93. DEPARTMENT OF TRANSPORTATION; CHANGEABLE MESSAGE
1.6SIGNS DURING INCLEMENT OR HAZARDOUS WEATHER CONDITIONS.
1.7(a) For purposes of this section, the following terms have the meanings given:
1.8(1) "changeable message sign" means a traffic control device that is capable of displaying
1.9one or more alternative messages on or alongside a roadway;
1.10(2) "commissioner" means the commissioner of transportation;
1.11(3) "inclement weather" means a forecasted or current weather condition of active
1.12precipitation, which includes but is not limited to rain, snow, sleet, or hail; fog, smoke, or
1.13other conditions that limit visibility; or when road surface conditions are deemed hazardous
1.14due to weather; and
1.15(4) "traffic safety message" means the display of a message or alert on a changeable
1.16message sign to provide road users information about traffic operation, regulations, warnings,
1.17guidance, or communications about a currently present and known threat or danger to public
1.18safety or the motoring public.
1.19(b) The commissioner must ensure that, during periods of inclement weather, a changeable
1.20message sign in operation on a highway displays a message reminding drivers to turn on
1.21their headlights. The message content must be clear and concise, convey a simple message,
1.22and minimize confusion and visual distraction. Where practicable, the changeable message
1.23system must be integrated with weather-monitoring systems to ensure the automated display
1.24of a traffic safety message.
1.25EFFECTIVE DATE.This section is effective the day following final enactment."
