1.5 "Sec. 12.
[325M.40] DATA SHARING PROHIBITED; CERTAIN AUTISM STUDIES.
1.6 Subdivision 1. Definitions. (a) For purposes of this section, the following terms have
1.7the meanings given.
1.8(b) "Business" means any corporation, partnership, proprietorship, firm, enterprise,
1.9franchise, association, organization, self-employed individual, or any other legal
entity that
1.10engages in either nonprofit or profit-making activities.
1.11(c) "Government entity" has the meaning given in section 13.02, subdivision 7a.
1.12(d) "Health care provider" means a provider under section 144.291, subdivision 2,
1.13paragraph (i), and includes health care providers who provide telehealth services
to Minnesota
1.14residents.
1.15 Subd. 2. Dissemination prohibited. A business, health care provider, or government
1.16entity must not disseminate the following data for purposes of researching autism
as a
1.17preventable disease:
1.18(1) data identifying an individual, including names, birthdates, addresses, telephone
1.19numbers, or electronic mail addresses; or
1.20(2) any other data that could reasonably be used to identify an individual.
1.21 Subd. 3. Enforcement. The attorney general may enforce this section pursuant to section
1.228.31. A government entity that violates this section is subject to the remedies and
penalties
1.23under sections 13.08, 13.085, and 13.09.
1.24EFFECTIVE DATE.This section is effective the day following final enactment."
