1.4Page 19, after line 26, insert:
1.5 "Sec. 25. Minnesota Statutes 2024, section 500.215, subdivision 1, is amended to read:
1.6 Subdivision 1.
General rule. (a) Any provision of any deed restriction, subdivision
1.7regulation, restrictive covenant, local ordinance, contract, rental agreement or regulation,
1.8or homeowners association document that limits the right of an owner or tenant of
residential
1.9property to display the flag of the United States
and, the flag of the State of Minnesota
, the
1.10National League of Families POW/MIA flag, the flag of any branch of the United States
1.11Armed Forces, or a Blue Star Service flag or a Gold Star Service flag, is void and
1.12unenforceable.
1.13(b) "Homeowners association document" includes the declaration, articles of
1.14incorporation, bylaws, and rules and regulations of:
1.15(1) a common interest community, as defined in section
515B.1-103(10), regardless of
1.16whether the common interest community is subject to chapter 515B; and
1.17(2) a residential community that is not a common interest community, as defined in
1.18section
515B.1-103(10).
1.19EFFECTIVE DATE.This section is effective the day following final enactment and
1.20applies to all limitations described in this section and not excepted in Minnesota
Statutes,
1.21section 500.215, subdivision 2, regardless of whether adopted before, on, or after
that date."
